Please carefully read these Sweepstakes Official Rules (the “Rules”) as they apply to your participation in the EarthKind® Fresh Cab® Fresh Summer Sweepstakes (the “Sweepstakes”). By participating in the Sweepstakes, you expressly agree to be bound by these Rules without modification.
THE SWEEPSTAKES IS SUBJECT TO ALL APPLICABLE FEDERAL, STATE, AND LOCAL LAWS AND REGULATIONS AND IS VOID WHERE PROHIBITED OR RESTRICTED.
SPONSOR
The sponsor of the Sweepstakes is EarthKind, LLC (“Sponsor”). The Sponsor may be contacted at 346-D East Plaza Drive, Mooresville, NC 28115.
SWEEPSTAKES PERIOD
The Sweepstakes begins at 12:00:01 AM Eastern Time (“ET”) on 6/15/2026 and ends at 11:59:59 PM ET on 07/05/2026 (herein referred to as “Sweepstakes Period”). The Sweepstakes Period consists of three (3) weekly entry periods (each, a “Weekly Entry Period”) and multiple weekly prize winners will be selected at the end of each such Weekly Entry Period from among all eligible entries received during such period.

Non-winning entries from any Weekly Entry Period WILL NOT roll over to subsequent Weekly Entry Periods. Sponsor’s computer (or that of its designee) is the official time-keeping device for all entries into the Sweepstakes.
ELIGIBILITY
The Sweepstakes is open to legal residents of the 48 contiguous United States of America, including the District of Columbia, who are age 18 or older at the time of entry. Void in Alaska, Hawaii, Puerto Rico, Guam, the U.S. Virgin Islands, outside the contiguous U.S., and wherever else prohibited by law. Employees of Sponsor and its respective subsidiaries, affiliates, advertising and promotion agencies, and the immediate family members (spouses, parents, children, and siblings and their spouses) of, and/or those living in the same household of each of the foregoing, are not eligible to enter.
HOW TO ENTER
Online submission to the Sweepstakes is the only eligible method of entry. During the Sweepstakes Period, visit http://earthkind.com/fresh-summer-sweepstakes and follow all entry instructions to complete the entry form and submit the entry form to enter the Sweepstakes (each, a “Submission”). Online entrants that provide a Submission are subject to all notices posted online including but not limited to the Sponsor’s Privacy Policy, which can be found at https://www.earthkind.com/policies/privacy-policy.
Individuals are allowed to enter a Submission for the Sweepstakes once during each Weekly Entry Period and non-winning Submissions do not roll over to subsequent Weekly Entry Period(s). A Submission will be considered complete only if all of the requirements set forth above are met and the online form is completed. Submissions that are incomplete or do not adhere to these Rules may be disqualified at the sole discretion of Sponsor. All Submissions become the property of the Sponsor and will not be acknowledged or returned.
Individuals may not enter more than once by using multiple email addresses, identities, or devices in an attempt to circumvent these Rules. Although subsequent attempts to enter the Sweepstakes on a given day may be received, only the first complete Submission received from a particular entrant will be eligible; subsequent attempts by the same person to enter, including entries submitted with an alternate email address, will be disqualified. Any individual that uses fraudulent methods or otherwise attempts to circumvent these Rules, may be removed from eligibility from participation in the Sweepstakes at the sole discretion of Sponsor.
PRIZES/APPROXIMATE RETAIL VALUE ("ARV")/ODDS
There are seventy-eight (78) total prizes available to be won in connection with the Sweepstakes.
Grand Prizes: There are three (3) grand prizes available to be won (one (1) per Weekly Entry Period). Each grand prize consists of one (1) Sizzling Summer Prize Pack that will be awarded in the name of the confirmed winner during each Weekly Entry Period. Each Sizzling Summer Prize Pack includes: (a) winner's choice of one (1) $250 gift card from Lowes®, Menards®, Tractor Supply®, or Camping World® (ARV: $250); (b) one (1) MEGA EarthKind® sample kit (ARV: $200); (c) one (1) Blackstone® 2-Burner 22" Adventure Ready Outdoor Griddle with hard cover (ARV: $150); (d) one (1) Blackstone® Pro 22-Piece Accessory Kit (ARV: $75); (e) two (2) Firepit Rockers (ARV: $175); and (f) one (1) RTIC® 30 Can Soft Cooler (ARV: $150). The ARV of each grand prize is: $1,000.00. The total ARV of all three (3) grand prizes is: $3,000.00. Gift cards are not redeemable for cash and will not be replaced if lost or stolen.
Second Place Prizes: There are thirty (30) second place prizes available to be won (ten (10) per Weekly Entry Period). Each second place prize consists of: (a) winner's choice of one (1) $100 gift card from Lowes®, Menards®, or Tractor Supply® (ARV: $100); and (b) one (1) EarthKind® sample kit (ARV: $50). The ARV of each second place prize is: $150.00. The total ARV of all Weekly 2nd Place Prizes is: $4,500.00. Gift cards are not redeemable for cash and will not be replaced if lost or stolen.
Third Place Prizes: There are forty-five (45) third place prizes available to be won (fifteen (15) per Weekly Entry Period). Each third place prize consists of: (a) winner's choice of one (1) $50 gift card from Lowes®, Menards®, or Tractor Supply® (ARV: $50); and (b) one (1) EarthKind® sample kit (ARV: $50). The ARV of each third place prize is: $100.00. The total ARV of all third place prizes is: $4,500.00. Gift cards are not redeemable for cash and will not be replaced if lost or stolen.
The total ARV of all prizes available to be won is $12,000.00.
The actual or appraised value of the prizes may differ at the time the prizes are awarded. The specifics of the prizes shall be solely determined by Sponsor. There is a limit of one (1) prize per person. Odds of winning will depend upon the total number of eligible Submissions received.
RANDOM DRAWING
The potential winners for each prize will be selected from among all eligible Submissions received in a random drawing to be held on each Drawing Date set forth above, which will take place at the offices of the Sponsor, whose decisions are final.
WINNER NOTIFICATION & VERIFICATION
Potential prize winners will be notified via email, and will be required to reply via email, within five (5) days of notification. Noncompliance will result in disqualification, and an alternate winner may be selected by Sponsor, in Sponsor’s sole discretion. The applicable prize will be awarded by mail within approximately 30-days after the winner is verified. If a winner is otherwise eligible under these Rules, but is nevertheless deemed a minor in his or her state of primary residence, the prize will be awarded in the name of the winner’s parent or legal guardian who will be required to execute and return the releases on minor’s behalf, as applicable.
If a prize notification or prize is returned as undeliverable, or if the winner is found to be ineligible or not in compliance with these Rules, in Sponsor’s sole discretion, that winner will be disqualified, and the prize may be awarded to an alternate winner in a separate random drawing. Only two (2) alternate winners for each prize available to be won may be determined through this process, after which the prize may remain un-awarded.
PRIZE CONDITIONS
Prizes are not redeemable for cash. Prizes are not assignable or transferable. No cash in lieu of prizes, and no exchange or substitution of prizes will be negotiated except at the sole discretion of the Sponsor. No substitution of the prizes may be made, except by Sponsor, who reserves the right (but has no obligation) to substitute all or any portion of any prize with another prize (or component thereof) of equal or greater value if any or all of any prize is not available for any reason as determined by Sponsor in its sole discretion.
Prizes are awarded “as is” with no warranty or guarantee, either expressed or implied by Sponsor. Winners acknowledge that the Sponsor and all other businesses affiliated with this Sweepstakes and their agents do not make, nor are in any manner responsible for any warranty, representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness or merchantability of any aspect of the prizes being offered, except that each merchandise prize shall be subject to its manufacturer’s standard warranty (if any). Once the prize has been delivered to the winner’s provided address, the prize is considered awarded. Each winner assumes all liability for any injury or damage caused or claimed to be caused, by participation in this Sweepstakes or use/misuse or redemption of any prize.
Any other incidental costs, fees, assessments and expenses associated with the prizes not specified herein are the winners’ sole responsibility. The value of any awarded prize will be taxable to the respective winner as income and winners are responsible for all federal, state, local and income taxes associated with winning a prize. Each winner is solely responsible for reporting and paying any and all applicable taxes, and should contact a tax advisor for any questions concerning taxes.
AUTHORIZED ACCOUNT HOLDER
In the event of a dispute over the identity of an entrant, entry will be deemed submitted by the Authorized Account Holder of the e-mail address included in the Submission. “Authorized Account Holder” means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor may ask any entrant or potential winner to provide Sponsor with proof, to Sponsor’s satisfaction, that such party is the authorized account holder of the email address associated with the entry. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. The Released Parties are not responsible for: (i) lost, late, misdirected, damaged or illegible entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in the Sweepstakes. By participating in the Sweepstakes, you (a) agree to be bound by these Rules, including all eligibility requirements, and (b) agree to be bound by the decisions of Sponsor, which are final and binding in all matters relating to the Sweepstakes. Failure to comply with these Rules may result in disqualification from the Sweepstakes. Sponsor reserves the right to: (x) permanently disqualify from any Sweepstakes it sponsors any person it believes has intentionally violated these Rules; and (y) withdraw a method of entry if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Sweepstakes). If for any reason this Sweepstakes is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes, at which time, Sponsor will conduct a random drawing from among all eligible entries received at the time of the Sweepstakes termination.
ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THIS WEBSITE OR INTERFERE WITH THE OPERATION OF THE SWEEPSTAKES, IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
DISPUTES
Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate state or federal court located in Mecklenburg County, North Carolina. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the state of North Carolina without giving effect to any choice of law or conflict of law rules (whether of the State of North Carolina or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of North Carolina. The remedy for any claim shall be limited to actual damages, and in no event shall any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney’s fees or other such related costs of bringing a claim, or to rescind this agreement or seek injunctive or any other equitable relief.
THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THIS AGREEMENT WHETHER SOUNDING IN CONTRACT OR TORT, AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.
LIMITATION OF LIABILITY; RELEASE
Entry into this Sweepstakes constitutes your agreement to release and hold harmless the Sponsor, Facebook, Twitter, Instagram, and their subsidiaries, representatives, affiliates, partners, advertising and promotion agencies, agents, successors and assigns, directors, officers, and employees (the “Released Parties”) from any and all claims, liability, loss, or damages that may occur, directly or indirectly from: (a) participation in this Sweepstakes; (b) a winner accepting, possessing, using, or misusing of any awarded prize; (c) any type of technical failure; (d) the unavailability or inaccessibility of any transmissions, phone, or Internet service; (e) unauthorized intervention in any part of the entry process or the Sweepstakes; or (f) electronic error or human error in the administration of the Sweepstakes or the processing of entries. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of any prize.
The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, any social media platform, including without limitation Facebook, Twitter or Instagram. Each entrant understands that you are providing your information to Sponsor and not to any social media platform. You hereby agree to release each social media platform – including Facebook, Twitter and Instagram – from any and all liabilities in connection with the Sweepstakes.
RIGHTS GRANTED BY YOU
By submitting an entry into this Sweepstakes, each entrant understands and agrees that the Sponsor, and any individual acting on the Sponsor’s behalf, shall, unless prohibited by law, have the right to print, publish, broadcast, distribute and use in any media known now or hereafter developed, in perpetuity, worldwide, and without limitation, the entrant’s Submission, name, photo, portrait, voice, likeness, image, statements about the Sweepstakes, and biographical information for news, publicity, advertising, promotional purposes, trade, information, and public relations without any further notice, review, consent, compensation, or remuneration.
AFFIDAVIT OF ELIGIBILITY
Each winner may be required to execute and return to Sponsor, where permitted and applicable, an Affidavit of Eligibility and Release (the “Affidavit”). If required, the Affidavit will be provided to a winner at the same time (or shortly after) such winner is notified pursuant to the section above entitled ‘WINNER NOTIFICATION & VERIFICATION’ and must be returned to Sponsor fully executed before the applicable prize will be awarded. By completing, signing and returning the Affidavit, the applicable winner: (a) releases and forever discharges Sponsor, its affiliates and subsidiaries, and their respective advertising and promotional agencies from all claims, demands, damages, actions and causes of action arising out of participation in the Sweepstakes or to arise by use of any prize (in whole or in part); and (b) confirms his or her compliance with these Rules.

A copy of the winners’ names or a copy of these Rules may be requested by sending such request via mail with a stamped, self-addressed envelope to: EarthKind 346-D East Plaza Drive, Mooresville, NC 28115. Requests must be postmarked no later than July 17, 2026.
